Gerald Ford once said that he was prepared to have his entire Presidency judged by the nomination of Justice Stevens to the Supreme Court.
George W. Bush ran on a promise to elect judges "in the mold of Scalia and Thomas."
John McCain is currently running on a promise to appoint judges like Alito and Roberts.
Barack Obama Souter, Breyer and Ginsburg as his model Supreme Court Justices.

No President or Presidential candidate in history has ever praised Anthony Kennedy as the model of a good Supreme Court Justice.

on law in the United States as he as been pretty busy writting majority opinions. If Obama wins, this influence will surely continue and grow, and more of the same types of decisions as mr. Kennedy's latest will go along with it.
I sure hope all our fellow conservatives who are still on the fence with McCain will wake-up to this reality before it is too late. The next President will most likely be replacing two liberal justices, and a Republican victory offers us the best chance of finally reigning in our often tyranical Supreme Court.

Principle above all else is their mantra...country be dammed...because their principles mean more than anything else...anything that is a compromise to their principles they cannot support even for the greater good...they are selfish and have no understanding of how full of pride they are...they aren't willing to sacrifice at all for the greater cause....it becomes a question of all or nothing to them and they have become satisfied with nothing because their principles must never be compromised...I am a principled conservative..but I will vote for McCain because I understand that it is better to have a Republican in office even if he isn't a trueconservative™ then to have a Marxist. But what do I know.

I have a friend like that. He's hoping for a big Republican loss this fall, and then for dramatic liberal legislative changes pushed by Obama/Democrats that inevitably lead us to economic trouble. He envisions then trueconservative Republicans will ride in for the rescue. All saying, I told you so no doubt. But all this sounded vaguely similar to the Nazi idea of a superman savior, too much for my liking. What he says will result is a restructuring of the Republican party, or the birth of viable conservative third party that will usurp Republican power and votes leaving the GOP to go the way of the Whigs.
Honestly, I would love a more conservative Republican party or viable more conservative third party, but given that the number of actual supporters such a conservative party could count on are not as numerous as he thinks makes me believe that his dream is at best unrealistic fantasy.
The reality is that the GOP needs, and has always needed independents/moderate and liberitarians to win the Presidency. Moreover, many districts and States just will not elect such trueconservatives. So are we to let these positions/seats fall to the Democrats out of a blind committment to conservative principles? Hell no.
So moderate Republicans won't tow the line on every little conservative initiative, at least we can count on them to oppose most of the liberal ones, and at least the compromises with them will be far less bitter than would otherwise be true with more Democrats in office.

... with the guy we were so pleased to see win the nomination. He just loves approving coverage from the media.
Now that Saint Sandra has departed and Kennedy is THE swing vote on many 5-4 decisions, the temptation is almost irresistible to cast the deciding vote that wins accolades for his thoughtful analysis of the Living Constitution. I used to think he was a little better than O'Connor, but man how he's "grown" since she left.
My only question now is how far to the left he'll run is McCan gets a conservative confirmed.
I'll bet it would shift him right. I think ego is driving Kennedy. As the swing vote now, tilting left gets him the media attention.
If we get 5 reasonably textualist judges on the court, his swing vote path to media attention is gone. Then to try to be a player (in service to his ego), he'll have to play ball with the conservative majority. The alternative for ego self-stroking is to try being the loudest source of thundering dissents, but I think Breyer or others would beat Kennedy in a competition for that role.
He joined Alito's majority opinion this morning on the campaign finance issue. Kennedy is not always on the wrong side.
Given that I'm increasingly involved in litigation at the Supreme Court level, I will not say further of him.
